Mediation
Patrick Moylan is an Accredited Mediator and has conducted successful mediations in a wide range of disputes throughout Ireland. He has written articles for various publications on the subject. He believes there is a form of mediation suitable to every dispute from the largest commercial dispute to the smallest local dispute.
Mediation is a confidential and voluntary process in which parties to a dispute attempt to reach a mutually acceptable agreement to resolve the dispute. By law, before you start court action, you must consider mediation to resolve your dispute
Benefits
- Avoids stress, cost and publicity of a court case and hearing
- Resolves disputes at an earlier stage so not ‘hanging over you’
- Relationships can be saved e.g. business dispute
- Can be beneficial for both sides of the dispute
- Significant cost saving
Even when the parties have agreed to use mediation, it remains voluntary. The parties are free to decide at any time not to continue. Once a settlement agreement is concluded and signed by the parties in mediation, it can be enforced like any other binding contract.
